LEWALLEN, Elizabeth  (Obituary)  Scott County News, Friday 26, Nov. 1926, Vol. 11, No. 36. P-1.  From Scott County, Tennessee Obituaries, 1926-1930, by Paul W. Lemasters, 1997 PP 55-56.

"Estimable Woman Dies at Huntsville last Saturday night, Nov. 19, 1926.  Mrs. Elizabeth Lewallen, commonly known by her many friends as "Aunt Betty" LEWALLEN, died at the home of her daughter, Mrs. Joseph Sharp near Huntsville, last Saturday night at 9:00 p.m.. Aunt Betty had been sick for several weeks, taking sick at the home of her daughter where she died.  She was 82 years of age and had lived in and around Huntsville in this county for practically all of her life.  Aunt Betty was one of the charter members of the Presbyterian Church at Huntsville and had lived a devoted Christian life for many years.  She had a host of friends as was evidenced by the large crowd and many beautiful floral offerings at her funeral last Tuesday afternoon.  There was a short service at the home of Mr. and Mrs. Sharp after which the remains were taken to the Presbyterian Church where the Funeral was preached by Rev. Hutchinson, pastor of the church to which she belonged.  F. M. Leavitt, local funeral director, was in charge of the funeral, burial taking place in the cemetery east of Huntsville. Mrs. Lewallen was survived by a son who lives in Oklahoma; two daughters, Mrs. Joseph Sharp and Mrs. Wm. Litton, both of Huntsville, several grandchildren and great Grandchildren, as well as a host of friends and relatives who mourns her loss."

Notes for WILLIAM HARRY LLEWELLYN:

Last name may be spelled Lewallen.

Burial: November 26, 1899, Jeffers Cemetery, Huntsville, Scott County, Tennessee

William Harry Lewallen enlisted in the Union Army, a Private in Company F 7th Regiment Tennessee Volunteers Infantry, June 7, 1862 for 3 years, at Huntsville, Scott County, Tennessee.  By order of Major General Wright he was transferred to Company A 1st East Tennessee Volunteers Infantry on April 30, 1863.

He appears on a list of Deserters, dated Nov. 30, 1864, while on furlough he deserted.  He appears on a list of Deserters dated Feb. 13, 1865.  He deserted on Nov. 5, 1864 in Kingston, Tennessee, he rejoined his unit Feb. 13, 1865.  He appears on a Co. Muster-Roll for January-February 1865 having returned following desertion, was in confinement.  He appears on a Co. Muster-Out Roll dated Sept. 17, 1864 but he was not mustered-out.  He appears on a Co. Muster-Out Roll dated Nashville, Tennessee, Aug. 31, 1864.  He was last paid on that date, $32.68. He was listed as Absent - in confinement at Knoxville, Tennessee undergoing sentence of General Court Martial-deserted Nov 5, 1864, returned Feb. 13, 1865; sentenced to be confined at hard labor for a period of six months.

He appears on a List of Discharges furnished by C. M. O. (Court Martial Orders) of State, under the provisions of circular dated A.G.O. (Attorney Generals Office), June 29, 1865.  Discharge furnished Aug. 28, 1865 and he was Honorably Discharged Aug. 3, 1865.

While on picket duty guarding a crossing on the Clinch River, near Kingston, Tennessee, William was wounded in the left thigh, by a comrade, Noah Dougherty, by accident.  According to the Affidavit of Lindsay Cooper, 2nd Lt. Co. A 1st Regt. Tenn. Inf., this is the way it happened, "Lewallen received a gunshot wound of the left thigh, caused by accidental discharge of a comrades gun (Noah Dougherty) while on picket duty, as the squad was gathering up their arms. He was sent to the hospital at Kingston. The wound has disabled him to about one-half that of an ordinary man.  I was present and saw said Lewallen when he was wounded; these facts are known to me from personal knowledge, the said Llewellyn or Lewallen.

Lewallen was a sound, stout, able bodied man when he entered the service and free from any disability, especially from gunshot wound."   There were three eyewitnesses to the shooting, Noah Dougherty (deceased, no affidavit), Frederick West (also deceased no affidavit) and Isaac Lindsey and his story differs from the other's who gave affidavits.  He claims that Lewallen, West and himself had left their post and had gone chasing lewd women and spent the night with a bad woman and her husband drinking whisky;  he said that he had nothing to do with the woman, but the other's did, at least they said that they did; and that Lewallen was shot while on the way back to camp.  He claims that they were supposed to be arrested by Lt. Cooper, but that they were not arrested and nothing ever happened to them.  Lindsay's reputation was not the best, but William was also known as a drunkard.  This affidavit was the reason for the delay in awarding a pension.

William applied for a Civil War Pension in May of 1883. (Pension Claim # 347944).  After several tries for pension, he finally was awarded a pension (Certificate # 532418) of $12.00 per month commencing July 19, 1890, due to gunshot wound and afflictions of the heart and lungs resulting from the measles.

On a decision of The Medical Division of Bureau of Pensions, December 7, 1895, Williams, Pension was dropped, effective Feb. 5, 1896. A declaration for Restoration to the Pension Roll was filed in Scott Co., Tennessee Feb 7, 1896, for the following reasons:  Wounded in both legs, Naso Pharyngeal Catarrh and nearly total deafness, and Rheumatism, piles, disease of the breast and lungs and general debility.  He was last paid the 4th day of November, 1895.  His pension was re-newed at $6.00 per month April 6, 1896 and increased to $12.00 April 12, 1899.

He died November 24, 1899, and his wife, Elizabeth Hembree Lewallen applied for a Widows pension in December of 1899; granted December 4, 1899 at $8.00 per month.

120.  JAMES MARTIN8 HEMBREE (MESHACK7, JOHN (JR.)6, JOHN (SR.)5, WILLIAM (JR.)4, WILLIAM (SR.)3, ISACC2, HENRY1) was born May 07, 1880 in Huntsville, Tennessee, Scott County, and died January 15, 1965 in Brocks Nursing Home; Atoka, Oklahoma, Atoka County.  He married MARY MAGDALENE LOWE July 14, 1901 in Huntsville, Tennessee, Scott County, daughter of MICHAEL LOWE and JUDITH MCGEE.

Notes for JAMES MARTIN HEMBREE:

                    JAMES MARTIN HEMBREE

                                1880-1965

Occupation: Blacksmith, and in later years Assembly of God Preacher.

Burial: January 19, 1965; Farris Cemetery, Farris, Atoka County, Oklahoma.

James Martin Hembree was born to Meshack and Ibey Hembree on May 7, 1880 in Huntsville, TN. He died Jan. 15, 1965 in a nursing home in Atoka, OK. He first appears on the 1880 Scott Co., TN. Census, 8th Civil Dist. July 18, 1880, in the home of Family # 411/412, Blag Jeffers as Jas. M. Hembree. 4 months (b. May 7, 1880). Why he was in that home is unknown. His parents were nearby, Family # 256 listed as Mesh (Meshack) 68, Farmer, Riller 27, wife, Harmon 7 son, Mary J (Jane) 5, daughter, Kissiah 3 daughter and William T. Hurst 4 months. Who or why William is listed with this family is also unknown.

James mother, Ibey, died on June 4, 1884 and Meshack died Jan. 21, 1885, leaving James and his sisters Mary Jane (b. 7-15-1874, & Kissiah (b. 11-18-1876), without any means of support. Their older half brother, William Alexander Hembree (Called Bill) was appointed by the court as their legal guardian. On Sept. 22, 1890 Bill applied for a pension for the three minor children of Meshack & Ibey Hembree. Several family members and friends gave affidavits to the pension board, including Harmon Hembree age 20, (older brother of three minors), Sarah Jeffers, Meshack's daughter, testified that she was a half sister to the three minors. In June 1891 Pharoba Smith (Ibey's mother) 73, testified that she was grandmother to the three minors and that she was present at each of their births. Also in 1891 Daniel and Sarah Jeffers testified that Meshack did not remarry after Surrilla's death (1884) and that the only minor children he had when he died were the 3 who applied for the Pension claims were filed on Jan. 7, 1867, by Meshack, and claims for minors on Oct. 17 1890 (#498963) and Aug. 3, 1902 (#478947); all were based on Meshack's rupture of his right side, caused by a barrel of salt falling upon him while engaged in unloading a wagon at the commissary at Somerset, KY, on Jan. 22, 1862. The pension was submitted for Special Examination and rejected on Nov. 17, 1902 and resubmitted Aug 25, 1903. All were rejected on the grounds that "Meshack's death, alleged to have been due to Brights Disease of the Kidneys, was caused by his military service-there is no valid evidence that his death was due to his military service".

In 1900 Scott Co., Census James Hembree is listed in the home of Phillip and Jemima Hembree Low (his half sister) family # 119.

On July 14, 1901 James married his school sweetheart, Mary Magdalene Lowe (b. Oct. 3, 1883 Huntsville, TN. d. March 21, 1964 in Antlers Hospital, Antlers, OK. They are both buried in Farris Cemetery, Farris, OK).

Soon after the marriage James & Mary left Tennessee and migrated west. They were accompanied by his half brother Ezekiel (b. May 25, 1841 d. January 18, 1918 OK.) his wife Barzilla Jane Bunch (b. 1842 d. ?? OK.) and family. It is also believed that Mary's parents, Mike Lowe (b. Jan 16, 1856 in Huntsville, TN. d. Aug. 16, 1916 in Atoka, OK.) and Judith Josephine Belle McGee (b. Jan 16, 1863 in Huntsville, TN. d. Christmas day 1935 in Farris, OK, Mike is buried in Atoka and Judy in Farris),made the trip from TN. to Indian Territory in 1901, Mary's 10 brothers and sisters, two more were born in OK in 1905 & 1908. They drove their cattle and went by wagon to Indian Territory. In 1902 James Hembree made a request for pension for the period before he became 16. He was living at the time in Choctaw Nations of Indian Territory (OK.); it was rejected.

Their first child, Mike was born June 12, 1902 in Gerty, Indian Territory (d. Dec 26, 1986 in Edmond, OK). The 2nd, Garfield, was born Feb. 7, 1904 also in Gerty, d. May 25, 1976 in Snyder, TX. Marion, b. Dec 10, 1905 Gerty, d. Aug. 25, 1968 was 3rd; Donia Lovis b. Jan 2, 1908 in Atoka, OK. d Mar 19, 1995 in Duncan, OK was 4th. The family relocated to Atoka where Matilda was born Sept 13, 1909 d. Dec. 25, 1936 in Wichita, Kansas; Hellen born June 1910 in Atoka, d. Dec. 16, 1919 (Burned to death from children playing with fire); next was Mary Jane b. July 24, 1913 in Atoka (Living in Bakersfield, CA. Will be 86 years old on July 24, 1999). Next is Elaine b. 1915 d. 1917; Then Frank Esaw b. May 24, 1918 in Tushka, OK. d. May 17, 1969, also born in Tushka was Harmon b. Nov 30, 1924 in Farris, d. May 13, 1982 in OK City, OK.

In the 1920 Atoka County, OK. Census, on the 5th & 6th of Jan 1920, James M. Hembree 39 Blacksmith, Mary 36, wife, Mike 17 son, Blacksmith helper, Garfield 15 son, Marion 14 son, Lovis 12, daughter, Matilda 10 daughter, Mary J. (Jane) 6 daughter, and Esaw 1 7/12ths son. They were living in Tushka, but moved soon after to Farris, OK. (Harmon b. May 26, 1919 should have been listed as well, but for some unknown reason was not listed).

James, or Jim as he was called worked in Atoka as a janitor at the Court House, as a Deputy sheriff, and operated his blacksmith shop in Farris, until he retired. He had a drinking problem until sometime in 1924/25, when he was saved and joined the church. He later became a Assembly of God Minister and preached. He built the Farris Assembly of God Church.

Jim & Mary had 13 children, ten lived to adulthood, one died at birth and two died in their childhood; only three are still living: Mary Jane, Harmon and Fannie Lou. (Feb. 7, 1999).

Isiah Hamilton Hembree was listed in the Scott County Federal Census for 1870  as Isiah H. Hembree, and in all other census as well as his Civil War Pension and Death Certificate he was listed as Hamilton Hembree.

Hamilton enlisted in the Union Army, as a private on Sept., 1, 1863, into Co. K, 49th Regiment, Kentucky Infantry, under the Command of Capt. John Guodiu.  He appears on a Muster-out Roll and was last paid on Dec. 26, 1864, he was honorably discharged on that date.

While in the service and in the line of duty at Camp Nelson, Ky. on or about Jan. 1864 he contracted measles resulting in heart disease, chronic diarrhea and rheumatism, caused by being overheated while on march from Bowling Green, KY. to Nashville, TN.. He was also injured while driving a wagon at Camp Nelson, when the wagon got stuck in the mud, suffering a rupture of his right side, while trying to lift the wagon wheel out of the mud.  There is also at least 2 affidavits of William and Marshall Goodin, who say that Hamilton's medical problems stem from a march from Camp Burnsides to Sloan Hill, when he got sick and was taken back to Camp Burnsides---though the stories are different, the problems are the same in these affidavits as well as from Joseph Low, Phillip Low, Robert Bluford Hembree, (his father), Pleasant Jeffers, William A. Hembree (his first cousin), James Hembree (his uncle), Isaac Duncan, John Massengale, Columbus Low and E. (Ezekiel) Hembree (first cousin once removed); they all agreed that Hamilton's physical problems existed.

Hamilton first applied for a pension on March 24, 1884 from Scott County, Tennessee (# 509284).  After many years of trying he tried again on Jan 20, 1892 and was awarded with a $6.00 per month pension (#721699) on Feb. 8, 1892.  He applied for pension increase in April 4, 1894.  His pension ended Aug. 2, 1894 and was reissued, $2.00 per month from Dec. 18, 1890 for Rheumatism and increased to $6.00 under the Act of March 2, 1895.  He applied for increases on May 2, 1900, Jan. 21, 1903 and received $10.00 per month commencing Aug. 24, 1903 and ending Dec. 15, 1903.  He received increases to $16.00 July 29, 1912; $20.00 Nov. 13, 1913; $24.00 Nov. 13, 1918; $35.00 June 10, 1918; $50.00 Sept. 15, 1921 and the last raise on April 5, 1924 to $72.00 per month.

He was born Nov. 13, 1843 on Smokey Creek, Scott County, Tennessee; he was 5 ft. 8 inches tall, had a fair complexion, light hair with gray eyes.  He died June 14, 1937, he was 93 years 5 months and 1 day old.  He was buried by Cooper's Funeral Home on June 15, 1937 in Lone Mountain Cemetery, Norma, Scott County,  Tennessee.
